The Board is an executive branch agency and has jurisdiction over appeals involving bid and contract disputes between the State and contractors and or vendors doing business with the State. Bid disputes involve the preparation and interpretation of bid specifications, qualification and selection of successful bidders or offerors, and matters relating to the bidding process.
The cases involving contract disputes relate to issues arising out of the contractual relationship between the State and a contractor. Issues would include quality of performance, compliance with contract provisions, compensation, claims and change orders, terminations, and any other matter that cannot be resolved between the State and the contractor. The Board has no authority involving the procurement of architectural and engineering services. Board decisions are subject to judicial review. Final decisions of the Board are used as precedent by State agencies and the contracting community.
